Any person can file a petition for cancellation of a registered design before the Controller of Designs. There is no requirement to demonstrate commercial interest — any person may challenge the registration on the prescribed grounds.
Grounds for cancellation include: the design was previously published in India or elsewhere, the design is not new or original, the design is not registrable under the Designs Act (e.g., it is primarily functional), or the registration was obtained fraudulently.
India does not have a formal pre-registration opposition procedure for designs like it does for trademarks. The primary mechanism to challenge a design is through a Cancellation Petition filed after registration. The term 'opposition' in design context typically refers to this cancellation procedure.
