We search the official IP India Trademark Registry database, which covers all pending and registered marks across 45 NICE classes. For comprehensive searches, we can also cover international databases such as WIPO Global Brand Database and USPTO TESS.
A search is not legally mandatory, but it is strongly recommended. Filing without a search risks receiving objections under Section 11 (relative grounds) if a similar mark already exists, wasting both time and government fees.
No search can guarantee registration because the Trademark Examiner may raise objections on absolute grounds (Section 9), such as descriptiveness. However, a thorough search significantly reduces the risk of relative-ground objections and third-party oppositions.
